Protecting the Medicaid Safety Net Act of 2008: Testimony before the Energy and Commerce Committee, Subcommittee on Health

Friday, April 4th, 2008

Chairman Dingell, chairman Pallone, ranking member of Deal, and the committee members: Thank you for the invitation to testify today on the important issue of the integrity of Medicaid and Medicaid. For me, I am Grace-Marie Turner, president and founder of the Galen Institute, a nonprofit organization dedicated to research and development and promoting public understanding to find solutions to the problems of our health system .

I served as a member of the Commission on Medicaid from 2005 to 2006, and we have many hearings in Washington and across the country to collect certificates of experts and citizens on the program.

We have heard hundreds of witnesses to the importance of Medicaid for millions of human beings. Medicaid is really the Auffangnetz for our health care system and a life line for low-income people and people with disabilities. It is vitally important for beneficiaries and for taxpayers that Medicaid is sustainable.

The CMS rules by legislation, by the Committee today to ensure that the expenditure of Medicaid dollars of taxpayers in a position to protect and preserve the program.

The GAO and the Inspector General have identified important areas where waste and even abuse of Medicaid funds.

The GAO found that many countries, games to improve their federal Medicaid reimbursement system, but “there is no guarantee that this increase in payments by the Confederation for Medicaid Services… GAO found that a State , the funds used to finance its programmes of education, and other [for other] does Medicaid uses. ”

It does not, and it may even harm beneficiaries. The land OIG found that medical institutes, such as residential care facilities, have been forced off tens of millions of dollars of payments to the States again, compromise on the quality of care for residents.

For example, a nursing home in Albany County, New York, had total operating costs over a period of three years, $ 70 million. Creative breakdown of the state payment of the upper limit at $ 132 million in payments to the facility.

But the hospice was required to surrender to the state, but all the 50 million United States dollars, which means it is also to a loss of $ 20 million and has been seriously under - effective. It is difficult to see how it among Medicaid patients.

In an effort to ensure that Medicaid dollars to pay for the treatment of our patients, it is appropriate to require that service providers and to keep the total amount of Medicaid payments they deserve.

The supplier proposed tax similar challenges.

The Office of the Inspector General has found numerous cases in which rights have been Medicaid, with patients who are ineligible or rehabilitation. There are, for example, situations in which the taxpayer was nonrehabilitative bill for services such as transportation for recipients of the grocery store, restaurants, or even bingo games.

Unless the control is one of those expenditures, states could undermine the ability of Medicaid’s medical services needed, and allows millions of Medicaid beneficiaries.

The CMS rules are not perfect, but rather than block, would be a better strategy for the Congress, the administration to produce financial measures to cope with such abuses.

The vast majority of providers of Medicaid patients to work for the best possible supply, both of the victims, such as doctors, patients, Medicaid, even though the payment to say that a financial loss. But if the United States, Gaming care system patient is not helped.

The OIG land, in this witness before the commission, it is working “to ensure that Medicaid costs are, in fact, medical assistance to Medicaid [and] recipients of funds are used for health care , provided in the annex to Des beneficiaries.

If benefits, it believes that Congress is the responsibility of the federal government are not allowed Medicaid spending, graduate medical education, it must be done by explicit.

Most of the abuse in the Medicaid program are FMAP or Federal Medical Assistance Percentage. Even though I do not have the time, in this matter of principle, and I quote in my written testimony of my colleagues Medicaid Commission Bob Helms of the American Enterprise Institute, which documents cause distortions that the nature of the abuse, that the rules are designed to address. It would be much better for the Congress to address this problem, and not as the basis for these problems of abuse, FMAP product.

We must begin the process of transforming this fragmentation of procedural rules-based program which focuses on patient care and coordinate better results. The quality of care for Medicaid recipients be improved if health care providers of patients who meet requirements and the program is not in the rules and bureaucratic regulations.

The proposals, which are aimed at the current legislation, in order to make greater stability of fiscal policy in the Medicaid program. These changes would drive estimated at 13 billion dollars from Medicaid, reducing expenditures by the Confederation in the next five years, from $ 1.2 trillion in United States dollars, the Confederation and Medicaid at this time there. While such changes represent approximately 1% of expenditures, but they were able to show that the desire for greater integrity in the program.

For more patients to Medicaid-focused, it must begin with the financing of health care in a new way. The quality of care is fully in the establishment of new incentives to achieve the best results. This means that new funding mechanisms should be compatible with the success of health providers and coordination of care plans for patients, the collection of information on all patients medical use, and most patients information and the responsibility of the partners in managing their health.

The focus on these objectives and to ensure taxpayers would be the first patient, it is said, and most importantly, patients who take care of the quality system in the field of care.

Thank you for the opportunity to testify today, and I welcome your questions.

Test case over free care home treatment for elderly may cost the NHS millions

Friday, April 4th, 2008

The NHS would have to pay back hundreds of millions of pounds and the costs of home care for the elderly, if a case of the High Court trial succeeded.

Nearly 400 retirees and their families were in a group action verklagend health authorities in Britain.

They argue that the right to the costs of long-term care in nursing homes because of health problems.

Reports of action for hope will be the case, the debate on the line between thedividing year “to health care for the elderly - which is financially supported by the NHS - and” social “for those who are fragile, but not sick.

For “social”, the local health authorities, the authorities receive royalty payments based on a test.

To evaluate the retired, there must be in health care in their home, costs spared.

But if it does not consider himself sick and have enough savings or assets valued at more than 21500 pounds, they have costs to the costs of home care, an average of 540 pounds per week.

Campaign for years argued that the tests unfair that many seniors and people with serious medical problems refused to free care.

At an initial hearing in the High Court yesterday, Barrister Rob Weir said Justice Eady, that hundreds of elderly has been an error of judgement.

One case was cited Platek Queenie, the payment of £ 57178 in the area of home care fees from 1998 until his death at age 92, during the year 2001, Nottinghamshire County Council, despite “wholly dependent on the other.”

It would be “totally immobile”, was fed by a tube that we see often complained of pain and was “somewhat confused”, or NHS officials argued that they do not need continuing medical care.

His son Richard Platek is verklagend on behalf of their real estate.

Another was Evan Jones, died at the age of 89 in a rest home in Swansea. His family is the complaint is lodged, the return of £ 73,000.

Mr. Weir said Jones had various medical problems and the failure to properly assess had him, the payment of taxes “under duress” in the last months of his life.

The NHS trusts, the action of the advocacy group claim it is an “abuse of process” and would have a transplant for judicial review of government policy in another section of the Tribunal.

Activists hope that the approval of a judge and three weeks of testing at the hearing again the case this year.

If the case is successful, thousands of people from more than home care are eligible for refunds.

“This problem concerns potentially most seniors in the area of health care, as well as their families,” said lawyer Malcolm Evans, for 400 claimants.

Nearly one of the six people older than 85 are available in the dormitories.

A classic four-year stay in a residential home £ 112000 costs and fees are rising faster than inflation.

This is the first time militants have an image on the number of patients with dementia, whose life is reduced by these drugs.

He revealed, the number of deaths in a report on the serious side effects of sedatives that cover more than 100000 patients with Alzheimer’s disease.

Mr. Burstow, said clinics have not been restated and frail with behavioural disorders habit fee of anti-psychotic drugs to control their anger and aggression, while many of them were used for the treatment of schizophrenia and manic depression, Alzheimer’s disease.

Studies have shown they may have high risk of stroke and two times higher than the death rate among users, but also rules for over 60 years are almost 40 percent during the recent years.

He added: “With the chemical drugs, delineates the elderly with dementia is not unlike the strapping to a chair. It is an abuse of human rights and human dignity.

“Prescription inadequate or improper is not just the elderly is reassuring to kill him.

On the frontline of abuse

Wednesday, April 2nd, 2008

HEADING exclusively on a young mother in the apartment to examine how they could deal with their babies, public health nurse Frances Grant thought they understood what you will be nearby. The mother, everybody knew that the issues of mental health, but after several home visits, Ms. Grant believes she had a relationship with her.

But, so far, without warning, the woman suddenly in the community nurse, and to cry abuse threats. “You schnappte and has been very aggressive,” she said. “I thought I wanted to attack. I tried to calm them down, but it has not worked, and I was so scared, so much so that I am the way, Ms. Grant, remembers how it rests in St. Bryce Dale surgery in Kirkcaldy.

While Ms. Grant reported the incident to the staff to find Fife, in practice, and concluded with him a colleague in the care of several later, which was as far as it has gone. In addition, it was a question of the call to the police, if a GP de Saint-Bryce Dale was cut from his room to another council violently patients had no treatment, he felt that it was due.

The management of such acts of abuse is regarded by many as the health of workers is a necessary component of their work. But from today, the legislation on the protection of doctors and nurses working in the Commonwealth of entry into force, to reduce the number of such attacks and make it clear that the abuses are unacceptable.

The move by the Scottish Executive to extend emergency the posting of workers, includes workers who are already at the hospital and emergency services, appointments routine in offices, clinics and patients at home. Now it is a crime to abuse or attack nurses, midwives and doctors, when and where they work.

Ms. Grant, 61, and worked as a public health nurse for nearly 25 years, hopes that improving the legislation of one will make the difference, for a problem of the deterioration. “I do home visits each day on my own,” she says. “Many of them are good, but some are not. There are people who call you, and sometimes you feel very vulnerable. Simply accepting, but there are more and more problems like this to public health nurses. I think it will help if people know now that the document has been to widen the criminal law for this type of behaviour. ”

Under the law, patients who are found guilty of abusive behaviour, including verbal aggression, with a maximum of 12 months in jail sentence and / or a fine of £ 10000

Since its launch in the year 2005 for the other in an emergency staff in Scotland, there are patients since 1200 against the charges, including more than 1000 have resulted in the repression, with 600 convictions to date.

However, in the same period, approximately, there were 1344 physical attacks and 305 cases of verbal aggression in the region as the only NHS Fife, on a large number of potential cases throughout the country.

National surveys of nurses views find Ms. Grant is convinced that there are things that are becoming more serious, with 34 2000 and increased by 40% by the year 2005.

Many incidents are not reported because the rest of the staff have the feeling that they must get in touch with her or abuse is not sufficiently serious measures, many other convictions at the hands of his action a success. Public Health Minister Shona Robison believes that the law is “very effective” and since there is a growing, while acknowledging a change in mindset is needed. The accentuation of changes yesterday in surgery from Kirkcaldy, said: “I think we still have a sub-culture of reporting, and I do not think anyone should feel that they must accept, as part of their abuse Labour. I think, with staff in some parts of the NHS, there is a bit of acceptance as part of its mission. However, in patients with a minority - perhaps greater than the past, it was - believe they are within their rights to be granted if they have been waiting for more as they wished, to abuse. With the enlargement of the law, we expect the numbers of repression on the rise, with people who may not be criminally prosecuted, there are now before the repression. We are talking about things like spitting and ropes. ”

She added: “The Government has a zero-tolerance approach to this kind of behaviour, and there is an ongoing campaign to get the message of man, for example through posters. ”

RCN Scotland Nursing Union welcomes the extension, but said that three to four hours in a work accident suffered by nurses in the context of violence, further measures are needed.

Norman Provan, Associate Director for Employment Relations RCN Scotland, said: “All employees in the health sector have the right to tell us more about their work without fear of abuse. We will continue within the framework of a partnership with politicians and NHS boards to reduce violence and aggression Where it falls.

“The effects of the aggression and violence in the workplace is huge. Nurses, the attacks are often traumatized left, and those who remain must be familiar with we lacked staff, while the person who was attacked, receive treatment or is off. ”

Practical measures that it seeks to create, view, the protection of personal mobile devices are also helping nurses to the call for help discreet, and more room or police protection.

Return to St. Bryce Dale, Dr Duncan Graham, one of five GPs in 6700, operated patients, says attacks on the site are scarce, and employees are increasingly rare to accept abuse. He said: “We humans zuschlagend doors and furniture saving time to time, but my experience here in over 26 years, we have only two episodes, the violence against employees, all of whom two in patients with Borderline, personality disorders, including an attack on a young doctor, leaving him with bruises. These patients were treated on the list, it is not the most important. The second incident a patient at risk of encountering a doctor at the reception.

“I think this kind of behaviour is increasingly a subject of increasing drug and alcohol under. Employees but are less tolerant and mouth when somebody off” to tell them that they are a doctor, and sometimes all it takes for we have a quiet word with the patient accordingly. ”

But with the government and the final movement controversial, to see the doctors and their staff a perfect Out-of-hours appointments, Dr. Duncan feared the risk of abuse could continue to rise.

“I hope that the extension of the law, as a deterrent, but the time is extended, we are confronted with a skeleton staff surgery later in the evening, perhaps our vulnerability.

DHS abuse report

Wednesday, April 2nd, 2008

I am an adult 65 years with a pair of medical problems that have left me homebound. I have many good friends who help me, purchase, transport, if I need a doctor, and I have a very good Home Health Care Nurse.

On Wednesday, March 12, was an invasion of my privacy Alan Stie, Oklahoma Department of Human Services (DHS), Adult Protective Services (APS), and someone said a complaint filed indication I was in danger . It harass me for 30 minutes to an hour, with a large number of issues, forcing me to prove that I was lined up three times (a medical term indicating I know who I am, where I am, as it is late, And I understand my situation complete). I was persuaded not in danger, but declined to say who filed the complaint. I started round, and found that there was a high probability that one of the social workers who are trying injuries has been one of my care, That was a very good job, but which do not ” is not the social security of workers has fallen.

Alan’s was head of the town, training, so I called his boss, but it would not help, either. I did some research online and presented the entire chain of command within the Agency and have worked my way of the chain, each time finding hoped that a bureaucrat would achieve an injustice has been done , but I did not find it.

They are all back: “We need to protect the identity of a person, a complaint that file,” but there are two problems in this respect. One is, I know that my neighbours reported his cousin, which will control itself, which is a nursing home, which was not to his medication, and the APS-agent, went home, had no problem, “says Cousin, Was my neighbour, adapting his visit. The other is that I had a look on the law, the DHS, “she says forced to treat the information as confidential, 43A OS § 10-110 , and section B.5 provides, they can say, a family member, and I told everyone, the chain of command that could stop me to say that, my brother, who is closer to my family, and you refused.

Last week, I blogged about it (http://snipurl.com/22dmr), and this week I am not alone on the blog it again (http://snipurl.com/22xgf), but I I also asked 30 other Check on Blogger, which makes, and I go to 16 people in the media, to see if it spreads it, and I am filing a complaint with four national agencies. If help? I do not know. But I hope that public opinion can no longer, I aufrüttelt, the less the likelihood of going to be DHS, after a few more at risk adults who do not want to exercise them.

I am personally not in jeapordy (I have many good friends and family loooking for me is that the state is not something to do for me), and the only reason why I pushed so far it is when they abuse the power of the state, with me, what they do, but to someone else, who are not, my knowledge and contacts with their protection.

I am confident that the division Human Services has done a good job, whether in the “Child Protective Services and Adult Protective Services. But we all saw on television the cases where an overly aggressive CPS removed Agent children and want to cry stay with their parents, and puts in “The System”, and we have seen, in all cases where “The System”, children with abusive parents Foster and the CPS, the agent Leader is overloaded or too lazy, Monitor, and are killed or injured. When we know, as one would imagine feel if your health has deteriorated to a point where you were sensitive for adults and one for Adults Protective Services started receiving a number of Invasives and degrading, yu keading feared, the power of the state could be used by them home and put them in an institution. And then think about what you think if you learn that your agent invasion of privacy, not because someone thought you were a danger to himself or others, but also because the person who had really tried DHS injure someone else, who has done a very good job.

Care package: Mandate issue, rates can’t be separated

Tuesday, April 1st, 2008

ADULT-aged babysitter Oklahoma to be paid at least an average of $ 8 per hour, depending on their Web sites, custody of children with customers. In return for the care, feeding and social interaction with the people, the elderly and nursing homes are paid in Oklahoma, on average,

The difference in child care, the elderly and nursing homes need the money to build and provide facilities, buy food, pay employees and their heating costs and buildings. Rather than children, their customers are usually the elderly in the final phase of life.

Given that the rates on home care costs range, babysitter, we understand the reluctance of owners to buy liability insurance. However, it order the Senate Bill 1549.

In a country where the Medicaid fees paid to nursing homes for the costs of care (they are more than $ 7 a day short), any part of the capital budget, insurance premiums? Eating? Collaborators? Utilities?

Insurance premiums can be up to $ 100000 per year for the policy and a high level of the share was relatively small. Never mind, say lawyers. Without insurance, the families of the residents could be penny on the dollar, in the case of misuse.

The lawyerly view, as usual, is an argument, wrapped in emotion. Cases of abuse and neglect in nursing homes are not hard to find - especially if you Trolling for them. If the solution is in the abuse of the accounts and home care, not everyone has, yet another case of lawyers, but not necessarily that they want to exert.

We support the right to health centres for alleged abuse or neglect. We are not gönne settlements, regardless of whether insurers home care or payable. But to force accountability reports on an industry in the most marginal utility of criminal fail, the more there are good better care.

The state may not be doing things in both directions. A dollar paid by a nursing home of the insurance is a dollar that is not readily to mind. It is little consolation for survivors of a disadvantaged improperly prepared. But, unless Oklahoma is ready to return at least equal to the average price for baby-sitting, the state has no coverage of the liability business mandates.

The industry wants a Medicaid to an average increase of $ 133.36 per day. The more they get, the more the pressure is the responsibility of the purchase. So be it. For today, the pressure on criminal policies and increasing the branch level of responsibility.

For politicians, this is a mere sop. For lawyers, it is no longer in the sauce sop their daily bread.

Baby-sitter, the drill when children are trying to do things in both directions: Gently but firmly, it should say no.
